1. Agreement to Terms

By accessing or using Dreamformer (“the Service”), including the dreamformer.ai website, the Dreamformer WordPress plugin, and Dreamformer Managed Hosting, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Dreamformer provides an AI-powered website builder for WordPress. The Service includes:

  • A WordPress plugin that generates web pages, themes, and code from natural language descriptions
  • An API that processes AI generation requests
  • Optional managed WordPress hosting with the plugin pre-installed

3. Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must provide accurate and complete information when creating your account. You must be at least 16 years old to create an account.

4. AI-Generated Content

Ownership: You own all content generated by the AI through your use of the Service. This includes HTML, CSS, JavaScript, PHP, images, and text produced by the AI based on your prompts.

Responsibility: You are solely responsible for reviewing and publishing AI-generated content. While the AI strives to produce accurate and appropriate content, it may occasionally generate content that is inaccurate, incomplete, or unsuitable. You should review all generated content before publishing it.

Restrictions: You may not use the Service to generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable. You may not use the Service to generate content that infringes on the intellectual property rights of others.

5. Credits and Billing

Credits: AI generation features consume credits. The free plan includes a monthly credit allowance. Paid plans provide additional credits. Credit usage varies by operation type and complexity. Unused credits do not roll over between billing periods.

Billing: Paid subscriptions are billed monthly or annually through our payment processor (Freemius/Paddle). You authorize us to charge your payment method at the start of each billing period.

Refunds: We offer a 14-day money-back guarantee on paid plugin plans. Managed hosting plans may be cancelled at any time; refunds for the current billing period are provided at our discretion.

6. Managed Hosting

If you subscribe to Dreamformer Managed Hosting:

  • We provide a dedicated server running WordPress with Dreamformer pre-installed
  • We manage server maintenance, security updates, SSL certificates, and daily backups
  • You are responsible for the content published on your hosted site
  • We reserve the right to suspend hosting if your site is used for illegal activities, distributing malware, or consuming excessive resources that affect other customers
  • Upon cancellation, your server data will be available for download for 14 days before deletion

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or extract the AI models or API
  • Resell or redistribute the Service without authorization
  • Use automated tools to make excessive API requests beyond normal usage
  • Interfere with or disrupt the Service or servers
  • Upload malicious code through the plugin or hosting service

8. Intellectual Property

The Dreamformer name, logo, website design, and plugin code are owned by Dreamformer and protected by intellectual property laws. You may not use our trademarks without prior written permission.

The WordPress plugin is distributed under a license that permits you to use it on your WordPress sites. This license does not grant ownership of the plugin code itself.

9. Limitation of Liability

To the maximum extent permitted by law, Dreamformer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose.

11. Termination

You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or engage in activity that we determine, in our sole discretion, may harm the Service or other users.

Upon termination, your right to use the Service ceases immediately. Content you have already generated and downloaded remains yours.

12. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.
